We recently had the privilege of assisting a client who had faced discrimination at work based on her religion and race. Her journey before coming to us had been challenging, navigating negotiations and legal avenues. However, we were able to step in and swiftly secure a positive outcome for her. We were able to finalise negotiations quickly, and she settled with a sense of satisfaction. I serve on the United States Commission on Civil Rights which examines the enforcement of federal civil rights laws, including federal hate crime law. With the rise in anti-Jewish and anti-Muslim hate crimes, all Americans can stand up and report a hate crime to the U.S. Department of Justice at https://lnkd.in/deFwTFQ9 As with the rise of anti-LGBTQ, anti-Asian, anti-Black, and anti-immigrant discrimination in the past, it’s important we stand up for each other and if you see something, WRITE something. Documentation and reporting of hate crimes is critical.

And sincerely: if you or anyone you know supports anti-trans laws, now is the time to dig deeper, learn more, and get on the right side of history on this issue. Read a book by a trans author about their lived experience navigating bigotry against them. Put yourself in the shoes of a parent whose child is trans, who is happy and whole living their gender like any other kid, but who can’t use a bathroom or play sports with their friends like any other kid. Imagine finally navigating the complexities of our health care system to find the best practices medical care for your health and your body, but to have access blocked by legislators who’ve enshrined bigotry into law. We don’t have to tolerate these cruelties. It’s a choice. We can all do better and I hope we will.

Frustrated by South Carolina's failure to adopt a comprehensive #hatecrime law in the aftermath of the 2015 #Charleston #massacre, I developed the idea of enacting #local hate crime #ordinances in States lacking hate crime #statutes. To that end, I drafted ADL's model hate crime #ordinance. In November 2018, Charleston was the first #SouthCarolina #municipality to adopt it. Six years later, "15 [South Carolina] #municipalities have passed local hate crime ordinances and pushed back against concerns that hate crime #legislation would erode #freespeech or lessen punishment for #crimes not motivated by #hate. Nine of the #cities and #towns that have passed laws do so just this year." However, such ordinances are not a panacea as they only apply to #misdemeanor #offenses and of course do not provide state-wide protections. South Carolina is one of four pariah states without a hate crime #law. Passage of the "The Clementa C. Pinckney Hate Crimes Act" by the #State #legislature is long over due. Across the globe, LGBTIQ people grapple with the constant threat of arrest, detention, and abuse simply for existing. Even in countries that do not explicitly criminalize queerness, stigma and prejudice are a daily part of life and shield perpetrators from accountability and justice. In September, Outright participated in the UN Commission on Crime Prevention and Criminal Justice’s two-day discussions on implementing the 2021 Kyoto Declaration on Advancing Crime Prevention, Criminal Justice, and the Rule of Law. The Director of our Queer Legal Futures program, Michelle Yesudas, went to Vienna to engage in constructive dialogue and to tell the hidden stories of those who fall through the cracks in unequal, queer-phobic criminal legal systems worldwide.
