Vs KAVITHA KURUGANTI 🥔 In the legal dispute between PepsiCo India Holdings Pvt Ltd and Kavitha Kuruganti over the registration of chipped potato variety FL 2027 under the Plant Varieties and Farmers' Rights Act, 2001, the appellant's application, initially misidentified as a "new variety," was later correctly categorized as an "extant variety" by the Registrar. However, the respondent sought revocation under Section 34 of the Act, alleging intentional misrepresentation and various irregularities. The appellant argued that the errors were unintentional and did not impact the registration. The court found the appellant's registration deficient due to incomplete documentation, leading to the revocation under Section 34(b) and (c). While disputing misuse of registration under Section 34(h), the court ruled in favor of the Authority, emphasizing the applicant's obligation to provide accurate information. The appeal was dismissed, highlighting the importance of strict adherence to regulatory requirements in variety registrations. However, there are some exceptions to this rule.
