General Summary

Directs, plans, organizes, manages, and provides direction and oversight for all functions and activities of TARC’s diversity, equity, and inclusion programs and activities related to civil rights compliance and the implementation and coordination of TARC policies and procedures and Federal Transit Administration (FTA) and Civil Rights Programs, including equal employment opportunity (EEO), Americans with Disabilities Act (ADA), Title VI, limited English proficiency and environmental justice. This position also performs a variety of legal support duties requiring the application of procedural, program, and compliance knowledge in support of the General Counsel. The position serves as the primary ADA Coordinator for ADA-related injury requests and reasonable accommodations; and compiles and organizes data regarding diversity and inclusion, professional development, and recruiting in compliance with the FTA. This position will support a safety and customer service culture through programs, procedures, and other related work to achieve TARC’s mission and strategic outcomes. The position is responsible for meeting or exceeding all TARC policies and procedures with strict adherence to all local, state, and federal regulations; and performing related duties as assigned .

Supervisory Responsibilities

Essential Duties And Responsibilities

  • Develops, manages, directs, and executes TARC’s civil rights programs, including but not limited to Federal, state, local, regulations, including strategic planning, conducting surveys and assessments, and working collaboratively to effectively apply equity and social justice practices within all departments.
  • Monitors and reviews policies and procedures; measures effectiveness; recommends changes or develops policies to ensure that TARC meets all business goals and objectives with regard to diversity, inclusion, compliance, and civil rights.
  • Prepares federal, state, and local regulatory reports and progress reports that are required; provides data and other statistical information.
  • Oversees and manages, in conjunction with the Training Department, the training materials and programs for all TARC Employees relating to diversity, inclusion, and compliance.
  • Manages, investigates, participates (if necessary), and responds to internal or external issues and complaints in the civil rights purview; provides support on employee relations matters.
  • Acts as the ADA coordinator for ADA injury request and reasonable accommodations.
  • Evaluates and review all employment data, including compensation, performance management, promotions, and selection practices as it relates to EEO and DEIB.
  • Partners with other TARC departments to maintain alignment of TARC’s mission with a culture of diversity, inclusion, and belonging; provides counsel and support to team members to ensure compliance and adherence.
  • Performs a variety of complex law-related tasks under the direction of the General Counsel.
  • Researches legal issues concerning the operations of a federally funded mass transit entity.
  • Participates and advises on grievances, mediations, and arbitrations and other labor relations matters.
  • Applies problem-solving techniques to successfully address issues and provide support for TARC’s management team.
  • Coordinates with General Counsel, and other risk partners to facilitate legal, administrative and/or compliance related work in an efficient and timely manner.
  • Assists in response to requests for information from various governmental agencies, civil subpoenas, open records requests, and other regulators. Prepares correspondence and memoranda on topics related to core responsibilities.
  • Recognizes legal issues and deviations from accepted/established practices.
  • As needed, participates in assigned TARC Board of Directors subcommittee meetings and makes presentations to the Board.
  • Provides supervisory responsibilities by monitoring department workload for efficiency, conducting annual reviews of staff performance, finding opportunities for and conducting training, addressing staff questions and concerns, developing individual goals and objectives for staff members, and interviewing and hiring staff.
  • Manages and participates in the development and administration of the department's annual budget; directs the forecast of additional funds needed for staffing, equipment, materials, and supplies; directs the monitoring of and approves expenditures; directs and implements adjustments as necessary
  • Monitors developments in legislation related to diversity, inclusion, and compliance matters and evaluates their impact on TARC operations; recommends and implements policy and procedural improvements to meet legislative obligations.
  • Attends and participates in professional group meetings; stays abreast of new trends and innovations training; researches emerging products and enhancements and their applicability to TARC’s needs.
  • Performs other job-related duties as requested.

MINIMUM EDUCATION AND EXPERIENCE:

  • Bachelor's degree f rom an accredited four-year college or university with major coursework in human resources, sociology, psychology, public administration, legal experience or law degree or a closely related field; and
  • Five (5) years of professional experience in civil rights, diversity, and inclusion programs including investigating complaints, preparing state and federal documentation, or conducting training, including two (2) years in a supervisor, management or compliance capacity within a diversity and equity environment .
  • Previous transit or government experience preferred.

Note: An equivalent combination of related education and experience may be substituted for the above-stated minimums excluding High School Diploma, GED, Licenses, or Certifications.

  • The structure and content of the English language including the meaning and spelling of words, rules of composition, and grammar.
  • Computers and software programs (e.g., Microsoft software pack ages, EthicsPoint, Ellipse, COM, etc. ) to conduct research, assess information, and/or prepare documentation.
  • Provide administrative, management, professional leadership, and direction for the assigned department.
  • Develop, implement, and administer goals, objectives, and procedures for providing effective and efficient diversity and inclusion programs.
  • Organize and implement organization workforce diversity, equity, inclusion, and outreach programs.
  • Exercise tact and diplomacy in dealing with sensitive and complex workforce diversity issues.
  • Research, survey, perform data collection and analysis, and deploy critical thinking and problem-solving.
  • Be fair, tolerant, sincere, and consistent in the application of policies and procedures relative to ethics and integrity while having the ability to mediate and use other techniques to resolve conflicts.
  • Establish and maintain cooperative working relationships with those contacted in the course of business, including employees, the Board of Directors, government entities, contractors, the community, and the general public.
  • Select and supervise staff; develop and direct people as they work by providing training to ensure tasks are performed effectively; oversee and evaluate performance in an objective and positive manner.
  • Handle confidential and sensitive information.
  • Multi-task in a fast-paced environment and work independently as well as collaboratively Prepare and administer large and complex budgets; allocate limited resources in a cost-effective manner.
  • Analyze problems, identify alternative solutions, project consequences of proposed actions, and implement recommendations in support of organization goals.
  • Communicate clearly and concisely, both orally and in writing, using appropriate English grammar and syntax.
  • Effectively use computer systems, applications, and modern business equipment to perform a variety of work tasks.

WORKING CONDITIONS:

Incumbents generally work in a typical office environment with adequate light and temperature. There may be occasional exposure to extreme temperatures, loud noise, fumes, noxious odors, dust, mist, gases, and poor ventilation; must be able to see, hear and speak; and sit at a desk for long periods of time. Work may require some level of mobility including lifting or moving materials. Incumbents may interact with upset staff and/or members of the public in interpreting and enforcing departmental policies and procedures. May be required to attend meetings outside of regular working hours.
