Effective July 8, 2024, the EPA has designated PFAS compounds PFOA and PFOS as CERCLA hazardous substances. This designation impacts landowner liability protections under CERCLA and increases the importance of identifying the presence or likely presence of PFAS as a Recognized Environmental Condition (REC) in a Phase I Environmental Site Assessment. Key Points to Consider During Due Diligence: 🔍 NAICS Codes: Check the NAICS code of current and historical businesses at the property, if available. If the facility operates in an industry that may have used PFAS (e.g., electroplating, wastewater treatment, textile coatings, landfills), obtain safety data sheets from the facility owner/operator, if possible. 💧 Chemical Releases: Investigate if other chemicals, such as chlorinated solvents, have been released at the site that could co-occur with PFAS. 🛢️ PFAS Evaluation: Assess PFAS storage, use, and waste streams similarly to other hazardous substances or petroleum products. 🌊 Off-Site Facilities: Consider that PFAS may migrate further in groundwater than other hazardous substances. 🔥 AFFF Use: Evaluate if there has been historical use of potential PFAS containing AFFF at the property such as during flammable fire response activities, testing of fire suppression systems, or fire training areas.
